Since the cancellation of the savings regulated in the Turkish Execution and Bankruptcy Law is a personal claim case that gives the creditor a foreclosure and sale authority, the transfer and sequestration of this receivable is possible. The condition that the saving subject to the cancellation proceedings developed by the Court of Cassation should be made after the birth of the debt may not be a credit originating from the exclusive person of the creditor who filed the cancellation lawsuit, but may also be a right or receivable acquired by the transfer. As a matter of fact, the annulment case is not exclusive to the beneficiary of the incapable document or to the creditor of the founding subject of the debt. Moreover, the personal nature of the case and the foreclosure and sale authorization granted to the creditor are not suitable for this. Regardless of the reason the debt arises, the cancellation case will be based on the date on which the debt was first born compared to the saving date, even if the creditor is not the founder of the subordinate or the basic debt relationship itself. In the event that the follow-up is based on foreign exchange deed, the form that acquires the deed according to the transfer forms and the legitimate bearer, after finalizing the follow-up regarding the receivable contained in the precious documents, will be able to request the cancellation of the saving with respect to the date of the birth of the debt even if it is not a party to the legal relationship that constitutes the body of the precious documents.
